These terms apply to your use of www.septibytes.com (the "website"), operated by SeptiBytes Solutions ("SeptiBytes", "we", "us"). By using the website you agree to them. If you do not agree, please do not use the website.
01These terms and client agreements
These terms cover the website only. Any services or product licences we provide, including custom software, data security, network infrastructure, MedicalBytes and CultiBytes, are governed by a separate written agreement signed with the client. Where that agreement and these terms differ, the agreement prevails.
02Information on the website
The website describes our services and products in general terms. It is provided for information only and is not an offer, a quotation or professional advice. Descriptions of features, approaches and commercial models are indicative and may change. Scope, price and timelines are confirmed only in a written proposal or agreement.
03Enquiries and proposals
Sending an enquiry does not create a contract or oblige either party to proceed. A contract exists only once a written agreement or signed proposal has been accepted by both parties.
04Intellectual property
The website and its content, including text, graphics, images, logos, datasheets and code, belong to SeptiBytes or its licensors and are protected by copyright and trade mark law. The SeptiBytes, MedicalBytes and CultiBytes names and logos are our trade marks. You may view the website and download datasheets for your own business evaluation. You may not copy, modify, republish or use any of it commercially without our written permission.
05Acceptable use
When using the website you agree not to:
- Use it in a way that breaks any law or infringes anyone's rights
- Try to gain unauthorised access to the website, its servers or any connected system, or probe or test its security without our written consent
- Introduce viruses or other harmful code, or interfere with the website's operation
- Scrape, harvest or bulk download content or email addresses
- Send us false information or impersonate anyone else
06Third party links and services
The website may link to other websites and uses third party services such as Google Analytics, Google Fonts, Google reCAPTCHA and Akismet. We do not control those services and are not responsible for their content or practices. Their own terms and privacy policies apply.
07Availability
We aim to keep the website available and accurate, but we do not guarantee that it will be uninterrupted, error free or free of harmful components. We may change, suspend or withdraw any part of it at any time.
08Disclaimer
To the extent the law allows, the website is provided as it is, without warranties of any kind, whether express or implied, including warranties of accuracy, completeness or fitness for a particular purpose.
09Limitation of liability
To the extent the law allows, SeptiBytes is not liable for any direct, indirect or consequential loss or damage arising from your use of, or inability to use, the website or any information on it, including loss of profit, data or goodwill. Nothing in these terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act, 68 of 2008, where it applies.
10Indemnity
You agree to indemnify SeptiBytes against any claim, loss or cost arising from your breach of these terms or your misuse of the website.

You agree that communications between us may be electronic, and that electronic communications satisfy any requirement that they be in writing, as allowed by the Electronic Communications and Transactions Act, 25 of 2002.
13Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. Continuing to use the website after a change means you accept the updated terms.
14Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
